This article addresses the fiduciary issues raised by the current practice of plan fiduciaries of not only disclaiming any fiduciary responsibility for brokerage window investments, but also abdicating any role (fiduciary or otherwise) in assessing even the general suitability of those investments for a retirement plan, and concludes that the practice is in plain and notorious violation of what ERISA requires of fiduciaries.

When, why, and how does interpersonal forgiveness occur? These questions guided recent research that compared the relative abilities of empathy versus motivated reasoning models to account for the influence of relationship closeness on interpersonal forgiveness. Consistent support was provided for the Model of Motivated Interpersonal Forgiveness. This model hypothesizes that following relationship transgressions, relationship closeness leads to a desire to maintain a relationship. Desire to maintain a relationship leads to motivated reasoning. And motivated reasoning fosters interpersonal forgiveness. The goal of (...) the present research was to examine two concerns that emerged from the initial support for the Model of Motivated Interpersonal Forgiveness. First, were the measures of motivated reasoning and interpersonal forgiveness conflated, thus reducing the potential for empathy to account for interpersonal forgiveness? Second, did the analytic estimation used reduce the power to detect the mediational role of empathy? The present research examined these questions. When motivated reasoning was measured by thought listings (in addition to the original questionnaire items) and when the analytic estimation provided greater power, the Model of Motivated Interpersonal Forgiveness was replicated. People in a prevention focus tend to view their goals as duties and obligations, whereas people in a promotion focus tend to view their goals as hopes and aspirations. The current research suggests that people’s attention goes to somewhat different experiences when they describe their hopes versus duties. Two studies randomly assigned participants (N = 953) to describe a hope versus duty. Specifically, Study 1 asked participants to describe a personal experience of pursuing a hope versus duty, and Study 2 (...) asked participants to describe a current hope versus duty they had. I analyzed these descriptions with Linguistic Inquiry and Word Count 2015. Consistent with earlier research on regulatory focus, participants wrote more about positive outcomes when describing hopes and social relationships when describing duties. The current research suggests that the effectiveness of common regulatory focus and regulatory fit manipulations could depend on participants’ freedom to choose the experiences they bring to mind when they describe their hopes and duties. Prevention focus is a self-regulatory orientation that serves the need for security, and promotion focus is a self-regulatory orientation that serves the need for growth. From mid-March to early April 2020, did people judge prevention focus to be more useful than promotion focus for responding to COVID-19? Our study tested and showed support for this hypothesis with 401 American and Canadian participants, who we sampled in 100-person waves on the first four Thursdays of the pandemic. For this study, we developed (...) a new measure of the judged usefulness of promotion and prevention focus. Additionally, results showed that the judged usefulness of promotion and prevention focus related positively to support of the psychological needs for autonomy and relatedness, respectively, in responding to COVID-19. Exploratory analyses showed that day-to-day differences in autonomy, competence, and relatedness support and in promotion and prevention focus tended to be small, which is notable given the large-scale changes to social distancing, employment, and media coverage of the virus during this time. Our research could be useful for crafting persuasive advocacy and narrative communications that encourage social distancing to protect others about whom people care most. (shrink)

A business ethics course can be viewed by students as primarily a topics course in which students discuss current events and voice their opinions about what the right course of action is for a company to take. A review of recent business ethics texts supports this perception as most texts expose students to many different normative theories and ethical issues, and provide tools to encourage a discussion of what conduct is right or wrong for a business to undertake. In these (...) texts, it is often hard to find a comprehensive framework for holding the course together in a meaningful, lasting way. This paper offers a semester long class project to complement existing texts by charging the class to establish criteria for determining the Most Ethical Company in My Town, thereby challenging students to develop their own framework. This article provides the steps of the project, tasks sheets, and summary of the resulting proposal that was presented to the Dean of the Business College for consideration for an annual college award. The resulting program is a learning tool for future classes as they play a role in annually nominating and evaluating submissions of ethical businesses for future awards. (shrink)

Numerous major holidays celebrate socially gathering in person. However, in major holidays that happened during the pandemic, desires to nurture relationships and maintain holiday traditions often conflicted with physical distancing and other measures to protect against COVID-19. The current research sought to understand wellbeing during American Thanksgiving in 2020, which happened 8months into the COVID-19 pandemic, after months of physical distancing and stay-at-home orders. American Thanksgiving is a major holiday not limited to any religion. We asked 404 American adults how (...) they spent Thanksgiving Day and to report on their experiences of that day. Predictors of wellbeing that we drew from self-determination theory were satisfaction of the fundamental needs for social connection, for doing what one really wants, and feeling effective. The predictors of wellbeing that we drew from regulatory focus theory were a focus on growth, and a focus on security. We found that feeling socially connected and focusing on growth related most strongly to wellbeing. Additionally, participants who saw even one other person face-to-face reported significantly higher relatedness satisfaction, promotion focus, and wellbeing than those who did not. Our research could help construct persuasive messages that encourage nurturing close relationships at major holidays while remaining safe against the virus. (shrink)

Mental time travel is the ability to mentally project oneself backward in time to relive past experiences and forward in time to pre-live possible future experiences. Previous work has focused on MTT in its voluntary form. Here, we introduce the notion of involuntary MTT. We examined involuntary versus voluntary and past versus future MTT in a diary study. We found that involuntary future event representations—defined as representations of possible personal future events that come to mind with no preceding search attempts—were (...) as common as involuntary autobiographical memories and similar to them regarding cuing and subjective qualities. Future MTT involved more positive and idyllic representations than past MTT. MTT into the distant future/past involved more representations of cultural life script events than MTT into the immediate past/future. The findings are discussed in relation to cultural learning and MTT considered as a higher mental process. (shrink)

Background Human brain organoids are a valuable research tool for studying brain development, physiology, and pathology. Yet, a host of potential ethical concerns are inherent in their creation. There is a growing group of bioethicists who acknowledge the moral imperative to develop brain organoid technologies and call for caution in this research. Although a relatively new technology, brain organoids and their uses are already being discussed in media literature. Media literature informs the public and policymakers but has the potential for (...) utopian or dystopian distortions. Thus, it is important to understand how this technology is portrayed to the public. Methods To investigate how brain organoids are displayed to the public, we conducted a systematic review of media literature indexed in the Nexis Uni database from 2013–2019. News and media source articles passing exclusion criteria (_n_ = 93) were scored to evaluate tone and relevant themes. Themes were validated with a pilot sample before being applied to the dataset. Thematic analysis assessed article tone, reported potential for the technology, and the scientific, social, and ethical contexts surrounding brain organoids research. Results Brain organoid publications became more frequent from 2013 to 2019. We observed increases in positively and negatively toned articles, suggesting growing polarization. While many sources discuss realistic applications of brain organoids, others suggest treatment and cures beyond the scope of the current technology. This could work to overhype the technology and disillusion patients and families by offering false hope. In the ethical narrative we observe a preoccupation with issues such as development of artificial consciousness and “humanization” of organoid-animal chimeras. Issues of regulation, ownership, and accuracy of the organoid models are rarely discussed. Conclusions Given the power that media have to inform or misinform the public, it is important this literature provides an accurate and balanced reflection of the therapeutic potential and associated ethical issues regarding brain organoid research. Our study suggests increasing polarization, coupled with misplaced and unfounded ethical concern. Given the inhibitory effects of public fear or disillusion on research funding, it is important media literature provides an accurate reflection of brain organoids. (shrink)

Several quantitative studies (e.g. Kidd & Castano, 2013a; Djikic et al., 2013) have shown a positive correlation between literary reading and empathy. However, the literary nature of the stimuli used in these studies has not been defined at a more detailed, stylistic level. In order to explore the stylistic underpinnings of the hypothesized link between literariness and empathy, we conducted a qualitative experiment in which the degree of stylistic foregrounding was manipulated. Subjects (N = 37) read versions of Katherine Mansfield's (...) 'The Fly', a short story rich in foregrounding, while marking striking and evocative passages of their choosing. Afterwards, they were asked to select three markings and elaborate on their experiences in writing. One group read the original story, while the other read a 'non-literary' version, produced by an established author of suspense fiction for young adults, where stylistic foregrounding was reduced. We found that the non-literary version elicited significantly more (p < 0.05) explicitly empathic responses than the original story. This finding stands in contradiction to widely accepted assumptions in recent research, but can be assimilated in alternative models of literariness and affect in literary reading (e.g. Cupchik et al., 1998). We present an analysis of the data with a view to offering more than one interpretation of the observed effects of stylistic foregrounding. (shrink)

OBJECTIVES: To compare 2005 and 1995 ethics guidelines from journal editors to authors regarding requirements for institutional review board (IRB) approval and conflict-of-interest (COI) disclosure. DESIGN: A descriptive study of the ethics guidelines published in 103 English-language biomedical journals listed in the Abridged Index Medicus in 1995 and 2005. Each journal was reviewed by the principal author and one of four independent reviewers. RESULTS: During the period, the proportion of journals requiring IRB approval increased from 42% (95% CI 32.2% to (...) 51.2%, p<0.001) to 76% (95% CI 66.4% to 83.1%, p<0.001). In 2005, an additional 9% referred to the Declaration of Helsinki or the International Committee of Medical Journal Editors' Uniform requirements for ethical guidelines; 15% (95% CI 8.5% to 22.5%, p<0.01) provided ambiguous or no requirements. The proportion of journals requiring COI disclosure increased from 75% (95% CI 66.6% to 83.3%, p<0.05) to 94% (95% CI 89.4% to 98.6%, p<0.05); 41% had comprehensive requirements, while some addressed only funding source (6%), were vague (10%) or both (14%). Criteria for authorship rose from 40% (95% CI 30.5% to 49.5%, p<0.05) to 72% (95% CI 63.3% to 80.7%, p<0.05). Journals with higher impact factors were more likely to require IRB approval (p<0.01). Journals in anaesthesia and radiology all required IRB approval; requirements in other disciplines varied. CONCLUSIONS: Instructions to authors regarding ethical standards have improved. Some remain incomplete, especially regarding the scope of disclosure of COI. The ethical guidelines presented to authors need further clarification and standardisation. (shrink)

Institutional review board delays may hinder the successful completion of federally funded research in the U.S. military. When this happens, time-sensitive, mission-relevant questions go unanswered. Research participants face unnecessary burdens and risks if delays squeeze recruitment timelines, resulting in inadequate sample sizes for definitive analyses. More broadly, military members are exposed to untested or undertested interventions, implemented by well-intentioned leaders who bypass the research process altogether. To illustrate, we offer two case examples. We posit that IRB delays often appear in (...) the service of managing institutional risk, rather than protecting research participants. Regulators may see more risk associated with moving quickly than risk related to delay, choosing to err on the side of bureaucracy. A common practice in textbooks is to introduce concepts or strategies in association with specific people. This practice aligns with research suggesting that using “real-world” contexts in textbooks increases students’ motivation and engagement. However, other research suggests this practice may interfere with transfer by distracting students or leading them to tie new knowledge too closely to the original learning context. The current study investigates the effects on learning and transfer of connecting mathematics strategies to specific people. A total of 180 (...) college students were presented with an example of a problem-solving strategy that was either linked with a specific person or presented without a person. Students who saw the example without a person were more likely to correctly transfer the novel strategy to new problems than students who saw the example presented with a person. These findings are the first evidence that using people to present new strategies is harmful for learning and transfer. (shrink)

What is the investment in holding onto this dichotomy?AL: There’s a familiar split in the notion of what a creative act is. That split, in our culture, (...) involves an idea of creativity as being natural and expressive: a poet has no need to have thought about anything in order to make a poem; the enemy is the analytical. This is a long-standing divisive space, certainly within the academy but also in the culture at large.JM: Over the past thirty years or so that space became institutionalized to greater and lesser degrees within the academy in the United States in the familiar tensions that came to exist in many universities between Creative Writing programs and programs in literary theory. Although both kinds of programs acquired substantial institutional power at a roughly similar pace, they’ve often seemed to move along parallel tracks that communicated with each other poorly or at cross-purposes. How do you see their prospects developing midway through the nineties?CB: Let me come at this in a different way. I think there’s enormous value in poets teaching literature in graduate as well as undergraduate programs. We need to have many different perspectives and methodologies in the classroom. For example, it can be a value that we have diametrically opposite perspectives on many of these questions. What particularly interests me as a model for teaching is having the active involvement of contemporary poets in both undergraduate and graduate classes teaching literature in what I would prefer to call “Creative Reading” rather than “Creative Writing” classes.JM: When you say, “We tend to view things from diametrically opposed perspectives,” who is the “we” you’re referring to?CB: Well, the category of “poets” in and of itself is too broad. There is no single perspective of poetry any more than there is a perspective of philosophy or theory. Poets themselves often have diametrically opposed perspectives on these very issues we’re talking about. So there isn’t a perspective of poetry. Poets as a group don’t bring any one thing. As a class in and of itself, it’s just too general. We explore the transformative impact that narratives can have on moral life, using examples from the story literature of Theravāda Buddhist traditions in Sri Lanka and Southeast Asia. This qualitative study explores the experiences and challenges SPED teachers face amidst the new normal of education. Employing Heidegerian Phenomenology and Interpretative Phenomenology analysis, findings suggest that the SPED teachers can’t enjoy their life outside work because of a lack of support from the government, physically and financially; thus, they experience burnout. Also, the salary they earn is not even enough to raise a family, and the fact that they almost shoulder the learning resources in the class makes it worse. (...) In September 2008, 10 years after the untimely death of Pere Alberch (1954–1998), the 20th Altenberg Workshop in Theoretical Biology gathered a group of Pere’s students, col- laborators, and colleagues (Figure 1) to celebrate his contribu- tions to the origins of EvoDevo. Hosted by the Konrad Lorenz Institute for Evolution and Cognition Research (KLI) outside Vienna, the group met for two days of discussion. The meeting was organized in tandem with a congress held in May 2008 at the Cavanilles Institute (...) for Biodiversity and Evolutionary Biology (ICBiBE) in Valencia, Spain. The talks at the KLI were equal parts: nostalgic remembrance, excitement over new ways of thinking about old problems, and an unrepressed vitriol against the resurgence of reductionist thinking in EvoDevo. Here we highlight some of the key aspects of Pere’s life and work that informed and infused the talks. (shrink)
